Acceptance of Conditions
By accessing our website or our services through any other means, including the use of telephone or email, or in person at our offices, you declare that you have read and agreed to our terms and conditions, and thus will be subject to them. We reserve the right to make changes and modifications to these Legal Terms at any time. We will inform all users about the changes made regarding the use of our site or services. You will automatically accept these modifications in case of a new registration and after changes have been made in the general conditions of contract. You must read carefully all the terms, in order to understand our conditions; since, this document constitutes a legal assurance between the users and VTW CONNECT MIAMI.
Reservations
All service requests will be processed by our on-site teams. If you are interested in a service and make a reservation request, we will ask for your contact information. VTW CONNECT MIAMI will mediate your reservation with service providers (hotels, carriers, airlines, etc.), subsequently sending you an offer or confirmation of services, along with an invoice for the requested services.
Payment
For clients who do not make reservations, access to our website is free, as well as the use of our services. If you have decided to book a stay or service, VTW CONNECT MIAMI is authorized to collect the amounts owed, in the manner negotiated and established between both parties. You will be required to make an initial payment, corresponding to 30% of said total amount, upon confirming the required services. VTW CONNECT MIAMI reserves the right to withhold part or all of the payments made, according to the cancellation policy described below.
Payments will not be accepted in cash or with checks, except in special circumstances or by mutual agreement between VTW CONNECT MIAMI and the client. As a customer, you agree that VTW CONNECT MIAMI may charge you an advance payment amount on your credit card, as agreed upon in the confirmation of the service reservation and in accordance with the information provided by you during the payment process. You also approve the payment of the difference between the total amount owed and the initial deposit (70% of the total owed), at most one month before your departure to the destination. In case the reservation process is made less than 45 days before the travel date, you must pay the ENTIRETY of the reservation to ensure the confirmation of the services, and for this amount, we will send you the initial invoice.
Termination
At any time, at our discretion and without prior liability to you, we may, with or without reason and without prior notice, do the following: (a) prohibit your access to our site, (b) delete and remove from circulation the content provided by you, and (c) deny access to any data or service.
Unauthorized uses
You agree that you must not do any of the following actions, unless it is previously authorized by us:
• Any commercial use other than through our previously validated membership or subscription.
• Using the tools of our platform to rent or select any accommodation that is not listed under any circumstance, without a valid subscription.
• Uploading, publishing, copying, reproducing, distributing, or transmitting the content of our site.
• Reproducing any part of our platform on another website, or replicating it with any goal(s).
• Modifying or creating sites or derivative works from our website, or any part of it.
• Using automatic devices or manual processes to monitor, copy, or store data from the contents of the site.
• Decompiling any part of the site.
• Using our databases for purposes other than querying or requesting tourist services, or the functions for which our page is designed.
• Using the platform to transmit, make public, or express any false, suspicious, or fraudulent information; including making a reservation of services with false intentions.
• Using our platform in a way that may incur in any criminal act of any kind.
• Posting, using, or transmitting through our website or using our trade names, any material that is illegal, threatening, abusive, defamatory, vulgar, obscene, sexually explicit, indecent, pornographic, or profane.
Use of our brand or logo
The use of our brands and logos in any way that has not been expressly authorized by VTW CONNECT MIAMI is strictly prohibited.
External links
We reserve the right to refuse external links or addresses of other websites and to eliminate them without prior notice or consent of any user.
Identity verification
You agree that you must safeguard your own online identification, as well as your password, and that such data must be strictly confidential.
You must notify us immediately if you suspect that your personal information has been compromised or is known by a suspicious person without your prior authorization. Likewise, if we believe that there has been any unauthorized use of your account, we will inform you and you must change it as soon as possible. We do not recommend offering your identification on our platform to anyone; however, if you do so and do not properly maintain your personal information, you will be solely responsible for any use made of such data, even if they are used in illegal or fraudulent acts, or cause monetary or other losses. Users should be aware that, in the event of any suspicious, illegal, or harmful activity to them or to VTW CONNECT MIAMI, we will proceed to cancel your account without prior notice, which is within our right to determine such actions.
Limitations:
All claims related to returns, losses, credits, or any similar matter made by customers to VTW CONNECT MIAMI, and related to accommodation in hotels or private homes, must meet the following two conditions: (i) they must have filed a report of the incident at the accommodation in question, in writing, and it must be duly received by the hotel or homeowner; and (ii) the complaint must have been made and received by VTW CONNECT MIAMI no later than 7 days after the completion date of your trip.
All complaints and claims related to returns, losses, credits, or any similar matter made by customers to VTW CONNECT MIAMI, and NOT related to accommodation in hotels or private homes, must have been made and received by VTW CONNECT MIAMI within 7 days after the completion date of your trip.
Notwithstanding the applicable statute of limitations, all claims against VTW CONNECT MIAMI related to the Services must be filed and duly notified to VTW CONNECT MIAMI, within one (1) year from the date of the event that gave rise to the action.
The fact that the Client does not timely submit a report or complaint shall constitute a complete defense against any claim or action initiated by the Client, related to the Services. Furthermore, the fact that the Client does not timely submit a report or claim shall be a complete defense against the Client's refusal to pay for any of the Services, including, among others, credit card charges for them.
The Client may not claim or initiate any claim against VTW CONNECT MIAMI unless and until the Client has paid for the Services in full.
All claims against VTW CONNECT MIAMI are subject to the other disclaimers of liability, limitations of liability, qualifications, and conditions set forth in this Agreement.
Changes to the program:
Although VTW CONNECT MIAMI works diligently to provide its services as described in our promotional materials and website, some circumstances beyond our control may affect your itinerary or the agreed services, necessitating us to substitute hotels and adjust service schedules. In such cases, VTW CONNECT MIAMI reserves the right to modify any scheduled reservation or activity.
VTW CONNECT MIAMI Limited Responsibilities
VTW CONNECT MIAMI guarantees the satisfactory execution of planned trips to the client, within the limits of the warranty provided by the service providers involved in the trip execution. Due to delays caused by technical reasons or weather conditions, we are not responsible for the consequences and costs of total or partial cancellation of hotels and transportation services. In such cases, we will endeavor to find and propose solutions to overcome the difficulties.
Representation
YOU declare that neither you nor anyone traveling with you has any physical condition or other disability that could pose a danger to yourself or others. VTW CONNECT MIAMI reserves the right to refuse the acceptance of any person on a trip and to withdraw, at your expense, any person whose condition is such that he or she could pose a danger to himself or others, or otherwise affect the enjoyment of other guests on the trip.
